Puredrive Energy Limited – Intelligent Octopus Flux Trial – Terms and Conditions

Puredrive Energy Limited (“PDE”, “we”, “us”, “our”)

Octopus Energy Limited and Kraken Technologies Limited (the “Service Supplier(s)”)

Duracell Energy Intelligent Octopus Flux Trial (the “Intelligent Octopus Flux Trial”)

Grid Services means any program that enables users of battery storage systems to send stored energy back to the National Grid or to be used to manage grid capacity.

PDE is conducting Beta testing of the Intelligent Octopus Flux service with the Service Suppliers. A maximum of 100 Trial Participants are to be involved in Beta testing.

These Terms and Conditions only apply to the Intelligent Octopus Flux Trial.

The Intelligent Octopus Flux Trial will last up to six months duration to the end of 2026.

The invitation to participate is not transferable and only applies to you if you have received a direct communication from us inviting you to take part in the Intelligent Octopus Flux Trial.

Participation

Participation in the Intelligent Octopus Flux Trial is only open to users of Duracell Energy Battery Storage Systems (“BSS”) which are not already participating in any other Grid Services offering. Trial Participants must be a current Octopus Energy customer or willing to become an Octopus Energy customer prior to testing. Trial Participants will have received an invitation to participate and have signed up for the Intelligent Octopus Flux Trial, in the form required, and have provided their Participant Consent for the full duration of the Intelligent Octopus Flux Trial (the “Trial Participant”).

Only one Trial Participant per Duracell Energy BSS may sign up to take part in the Intelligent Octopus Flux Trial.

We will be required to submit data about you and your Duracell Energy BSS (the “Shared Data”) to the Service Supplier(s) for use by them and their service providers involved in procuring the Grid Services as part of the Intelligent Octopus Flux Trial.

Participant Consent

· By signing up to participate in the Intelligent Octopus Flux Trial you acknowledge and agree that:

· You are consenting to us sharing the Shared Data with the Service Supplier(s) and for us and the Service Supplier(s) to use the Shared Data for the purposes of procuring Grid Services as part of the Intelligent Octopus Flux Trial.

· You are consenting to us applying charge and discharge and idle controls to your BSS during the Intelligent Octopus Flux Trial in response to energy market requirements.

· Your continuing participation in the Intelligent Octopus Flux Trial will be deemed as continuing Participant Consent throughout the period of the Trial.

· PDE and the Service Supplier(s) shall operate as joint Data Controllers for the Shared Data

· PDE shall operate as Data Controller for any other data associated with you and your BSS which we are either already processing or will process ourselves for the purposes of the Intelligent Octopus Flux Trial.

Without your consent, we will be unable to register your details to participate in the Intelligent Octopus Flux Trial.

If you send us your details for registration without providing your consent, we shall remove those details from our systems, and you will not be contacted about the Intelligent Octopus Flux Trial.

If you sign up to participate in the Intelligent Octopus Flux Trial but withdraw your consent during the Intelligent Octopus Flux Trial you will not be eligible to participate further, but we shall retain any Shared Data or other Personal Data already provided to us for as long as it is required to complete the Intelligent Octopus Flux Trial and to comply with our obligations in respect of the Intelligent Octopus Flux Trial. We will stop sharing the Shared Data with the Service Supplier(s) and shall notify the Service Supplier(s) that you have withdrawn from the Intelligent Octopus Flux Trial. You can withdraw your consent and participation by sending an email with the words “Octopus Trial withdraw consent” either to legal@puredrive-energy.co.uk or in reply to any of the sign-up emails.

Neither PDE nor the Service Supplier(s) makes any guarantee that your BSS is suitable for the Intelligent Octopus Flux Trial.

Your BSS may be deemed unsuitable and, in these circumstances, may be removed from the Intelligent Octopus Flux Trial either temporarily or permanently.

Your removal or alteration of any commands applied to your BSS by us for the purposes of the Intelligent Octopus Flux Trial will be deemed to be a withdrawal of Participant Consent.

The following Shared Data will be shared between PDE and the Service Supplier(s):

The name of your Duracell Energy BSS (your “System”) (your inverter serial number)

Your Octopus Energy ID

The amount of energy capacity of your System

The dates and times and metering information for periods of use during the Intelligent Octopus Flux Trial

Current System performance metrics and System performance summary

These Terms and Conditions are in addition to your statutory rights. Participation in the Intelligent Octopus Flux Trial does not affect your statutory rights, in particular in relation to the UK GDPR and Data Protection Act 2018.
